  • Study: Many schools don’t follow no-detention policy

  • Only 19% of government school principals across Karnataka are aware of the no-detention policy in the Right of Children to Free and Compulsory Education (RTE) Act 2009. The policy stipulates that no child can be held back for a year until he/she completes elementary education.

  • A recent empirical study conducted by the National Law School of India University (NLSIU) on the implementation of the RTE Act has found that of the 76 schools that were surveyed across all four divisions in Karnataka, 51 head of institutions were not aware of the policy. As a result, many schools continue to conduct examinations and detain elementary school students.

  • Some practices that continued to be followed in violation of the Act were the screening of students, and management of private schools often asking parents of students admitted under the RTE quota to pay fees. The study also found that many teachers were engaging in private tuitions.

  • However, there was considerably high awareness on corporal punishment in schools with 87.10% of government school teachers being aware of the ban.

  • Most presidents and members of the gram panchayat had no clarity about the funds they receive for the implementation of the Act. It is the local authority that is responsible for implementing the Act and they receive funds from the same. The study also revealed that girls were discriminated against.
